These Terms and Conditions ("Terms") govern your use of codethatships.com and the purchase and access of digital products offered by moralinfrei UG (haftungsbeschränkt) ("we", "us", "our"). By using our website or purchasing our products, you agree to these Terms.

2. Products and Services

We sell digital products, primarily the ebook "Nothing Shared, Everything Gained" and associated materials such as code examples and supplementary files. Products are delivered digitally via our website using a unique access token.

3. Pricing and Payment

Our products use a "pay what you want" model. You may choose to pay any amount, including zero. Suggested prices are displayed but not mandatory. All payments are processed securely through Stripe. Prices are displayed in Euros (€). As a small business under §19 UStG (German VAT Act), we do not charge VAT.

4. Delivery

Upon successful purchase (including free purchases), you will receive immediate access to the digital product via a unique token. If you provided an email address, you can request this token to be resent at any time.

5. Right of Withdrawal (EU Consumers)

For consumers in the European Union: You generally have the right to withdraw from a distance contract within 14 days without giving any reason.

However, for digital content not supplied on a tangible medium, you acknowledge that: (a) by clicking the purchase button, you expressly request immediate access to the digital content; (b) you expressly consent to the immediate performance of the contract; and (c) you acknowledge that you thereby lose your right of withdrawal once the digital content has been fully provided to you.

For acquisitions where the price is €0: No contract for the purchase of digital content is formed when no payment is made; therefore, withdrawal rights under consumer law do not apply.

Upon purchase, you receive a personal, non-exclusive, non-transferable license to access and use the digital content for your own personal or professional development.

All content, including text, code examples, graphics, and other materials, is protected by copyright and remains the property of moralinfrei UG (haftungsbeschränkt) and its author, Kore Nordmann. The book contains its own copyright notice. Purchase grants a license to use the content, not ownership of the intellectual property.

8. Disclaimer

The content is provided for educational purposes. While we strive for accuracy, we make no warranties about the completeness, reliability, or suitability of the information. Any reliance on the content is at your own risk. The techniques and patterns described are general guidance and may not be suitable for all situations. Professional judgment should be applied when implementing any changes to software systems.

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our products or services. Our total liability shall not exceed the amount you paid for the product.

Access to purchased content is provided via a unique token. You are responsible for keeping your token secure. We are not responsible for unauthorized access resulting from your failure to protect your token.

12. Updates and New Editions

We may update purchased content from time to time. Minor updates include: error corrections, typo fixes, small clarifications, and technical corrections. Minor updates will be made available to existing purchasers at no additional cost.

A new edition constitutes: substantial new chapters, major restructuring, or significant new content. New editions may be offered separately and will be announced with discounts for existing purchasers.

We reserve the right to determine what constitutes a minor update versus a new edition.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of Germany. For consumers in the EU, mandatory consumer protection laws of your country of residence also apply. Any disputes shall be resolved in the courts of Hagen, Germany, unless mandatory consumer protection laws provide otherwise.

We are willing to participate in dispute resolution proceedings before a consumer arbitration board.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
